1. About influenca and the Service
influenca is an online marketplace that connects small and medium-sized businesses with digital creators and marketing agencies to facilitate influencer marketing collaborations across social media channels in the MENA region.
The platform allows brands to discover and book creators, allows creators to list packages and manage orders, and allows agencies to manage multi-client campaigns from a single dashboard. All transactions are protected by an escrow mechanism that holds payment until delivery requirements are verified.
2. Eligibility
By accepting these Terms and creating an account, you represent and warrant that you:
- Are at least 18 years of age in accordance with the Jordanian Civil Code.
- Have full legal capacity to enter into binding contracts.
- Are using the platform for lawful commercial purposes.
- Have not previously had an account closed for violating these Terms.
If you are acting on behalf of a legal entity (company, sole proprietorship, agency), you additionally warrant that you are duly authorised to act on that entity's behalf.
3. Account Responsibilities
3.1 Registration Information
You are responsible for the accuracy and completeness of all information you provide at registration and at any subsequent time. Your profile must reflect your actual identity or the identity of the entity you represent.
3.2 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at legal@influenca.com if you suspect any unauthorised access.
3.3 One Account per Person or Entity
Only one account per natural person or legal entity is permitted. Multiple accounts for the same person or entity constitute a violation and result in immediate suspension.
4. User Roles and Rights
4.1 Brand (Client)
Brands may:
- Browse approved creator profiles and their packages.
- Send direct booking requests to creators.
- Review submitted content drafts and approve or request revisions.
- Open a dispute under the dispute resolution mechanism set out in these Terms.
Brands undertake to:
- Provide a campaign brief in good faith with all material requirements before placing an order.
- Review submitted drafts and respond with approval or a revision request within 72 hours of delivery.
- Refrain from expanding the scope of work agreed in the package without agreeing additional compensation.
- Not contact the creator outside the platform with the intent to circumvent the escrow system.
4.2 Creator (Influencer)
Creators may:
- List packages and set prices freely within platform policy.
- Accept or decline booking requests within the 72-hour window.
- Submit drafts and request clarification via in-platform messaging.
- Receive payment upon order completion and post verification.
Creators undertake to:
- Deliver original content that matches the package description and agreed brief.
- Include the recommended advertising disclosure tag on every promotional post (see Section 7 below).
- Not use purchased followers, bought engagement, or engagement pods.
- Meet agreed delivery deadlines and notify the brand promptly if unable to do so.
4.3 Agency
An agency is an advanced client that manages campaigns on behalf of other clients. Agencies hold the same rights as brands within a multi-client management context. The agency bears full financial and contractual responsibility for all orders it creates, regardless of its internal relationship with its end clients.
4.4 Administration (influenca)
influenca retains the right to review accounts, content, and orders; issue dispute resolution decisions; and suspend or terminate accounts in accordance with these Terms.
5. Transaction Flow: Order, Escrow, Delivery, Release
5.1 Order Journey
- Booking — The brand sends a booking request for a specific package from a specific creator.
- Acceptance — The creator accepts or declines within 72 hours. If no response is received within 72 hours, the order is automatically cancelled and the full payment is refunded to the brand.
- Execution — The creator produces the content and submits the draft via the platform.
- Review — The brand reviews the draft within 72 hours and either approves it or requests a revision (maximum two revisions per the package terms).
- Publication — The approved content is published; the creator submits the post URL via the platform.
- Verification and Release — influenca verifies the post URL and releases the escrow funds to the creator.
5.2 Escrow
The full order value is held in escrow by influenca upon payment confirmation. Funds are released to the creator only when:
- The brand has explicitly approved the content, and
- Publication of the post on the agreed social media platform has been confirmed.
The creator has no entitlement to the escrowed funds before both conditions are met.
6. Platform Fees and Payments
influenca charges the following fees on each completed transaction:
- Brand surcharge: 5% added on top of the package price (calculated and shown clearly on the review page before payment is completed).
- Creator commission: 10% deducted from the order value before funds are released to the creator.
- Total platform margin: 15% of the package value retained by influenca on order completion.
Payment-gateway processing fees charged by third-party processors (HyperPay, Stripe) may not be refundable in all refund scenarios. influenca absorbs these fees in full-refund scenarios caused by creator non-acceptance or delivery failure (see the Refund Policy).
7. Advertising Disclosure Obligations
7.1 Regulatory Framework by Market
Disclosure requirements vary by market:
- Saudi Arabia: The General Authority for Audiovisual Media (GCAM) imposes mandatory disclosure with active enforcement and fines.
- United Arab Emirates: The National Media Council (NMC, effective January 2026) requires mandatory sponsorship disclosure with active enforcement.
- Jordan: There is no specific influencer-disclosure law. Consumer Protection Law No. 7 of 2017 prohibits misleading advertising but does not mandate a specific disclosure hashtag. We strongly recommend creators follow promotional-content disclosure best practices (such as the
#إعلانtag) for consumer protection under this law.
7.2 Recommended Disclosure Tags
It is strongly recommended that the disclosure tag be included prominently at the beginning of the post or in a clearly visible position, using one of the following:
#إعلان or #اعلان_مدفوع or #بالتعاون_مع
The tag must be legible and must not be buried among dozens of unrelated hashtags. In markets where disclosure is mandatory (KSA and UAE), failure to disclose may result in temporary or permanent suspension.
7.3 Liability
influenca makes reasonable efforts to verify disclosure before releasing escrow funds; however, the creator bears full legal liability towards regulatory authorities in markets where disclosure is a mandatory legal requirement.
8. Prohibited Content and Conduct
Creators and brands must not use the platform to produce, promote, or distribute:
- Sexually explicit or nudity-containing content.
- Gambling promotion or online betting advertisements.
- Content that disparages or mocks religious beliefs.
- Political advertising or campaign materials.
- Alcohol brand promotion. (Note: alcohol consumption is legal in Jordan but commercial promotion is subject to restrictions.)
Full details of prohibited categories are set out in the Acceptable Use Policy.
9. Dispute Resolution
9.1 In-Platform Dispute Mechanism
If a dispute arises between a brand and a creator regarding the substance of a delivery, either party may open a dispute via the order interface within 14 days of draft submission or publication.
9.2 influenca Mediation
influenca's team will review evidence submitted by both parties (drafts, messages, brief) and issue a reasoned decision within 5 business days. influenca's mediation decisions are final at the first instance.
9.3 Judicial Escalation
If either party does not accept influenca's decision, they may pursue the matter before the competent courts in Amman, Jordan, under Jordanian law.
10. Account Suspension and Termination
influenca reserves the right to suspend or terminate your account in the following circumstances:
- Violation of these Terms or the Acceptable Use Policy.
- Providing false or misleading information.
- Engaging in escrow circumvention or off-platform transactions.
- Accumulation of multiple disputes affecting account trustworthiness.
- Compliance with court orders or regulatory authority requests.
Upon termination, escrowed funds are returned in accordance with the applicable refund policy.
11. Limitation of Liability
influenca is not liable for any indirect, consequential, incidental, or punitive losses or damages, including business losses, lost profits, or lost opportunities.
In all circumstances, influenca's maximum liability to you for any claim is limited to the total fees you paid to the platform in the twelve months preceding the incident giving rise to the claim.
12. Modifications to These Terms
influenca reserves the right to modify these Terms at any time. If a material change is made (one that affects rights or financial obligations), users will be notified and required to accept the updated version before continuing to use the platform. Non-material changes (typographical corrections, clarifications) take effect without requiring re-acceptance.
13. Governing Law and Jurisdiction
This agreement is governed by and construed in accordance with the laws of Jordan. The courts of Amman have exclusive jurisdiction to determine any dispute arising out of or in connection with this agreement.
